Nature’s Garden Rewards Loyalty Program
TERMS AND CONDITIONS
Welcome to the Nature’s Garden Rewards loyalty program (hereinafter “NGR”). This program is organized by ColorFast, Inc., an Ohio corporation doing business as Nature’s Garden, (hereinafter “Nature’s Garden”) and these Terms and Conditions (hereinafter “Terms”) govern your participation in NGR.
1.Agreement to Terms and Conditions
Please read these Terms carefully. By participating in NGR, you agree to be bound by these Terms, as well as the Website Terms of Use (hereinafter “Website Terms”) which are incorporated by reference herein with respect to your use of the Website; and you have read and acknowledged the Nature’s Garden Privacy Policy (hereinafter “Privacy Policy”), grant your consent for Nature’s Garden to process data that is personal to you, and to disclose such data to third parties, in accordance with the Privacy Policy which you have read and acknowledged.
These Terms supersede any previous terms and conditions of NGR or any prior loyalty programs offered by Nature’s Garden. Nature’s Garden may at any time amend, modify, or supplement these Terms, and continued participation in NGR after such changes will constitute your acceptance of any such amendment, modification or supplementation. Any changes are effective when posted on the Website. You are responsible for checking these Terms and any changes, modifications, or additions to NGR, these Terms or the Privacy Policy.
If at any time you find that you disagree with these Terms, it is incumbent on you to cancel your membership.
2.Program Eligibility
To participate in NGR, you must be at least 16 years old and a legal resident of the United States. Employees of Nature’s Garden, its affiliates and subsidiaries, and their spouses and children are not eligible to participate in NGR. Bulk buyers and resellers are not eligible to participate in NGR, unless given the right to do so from Nature's Garden. Nature’s Garden reserves the right to revoke loyalty membership for any reason. By enrolling and participating in NGR, you represent that you meet these eligibility requirements.
3.Program Enrollment
If you meet the eligibility criteria above, you can join NGR by visitingnaturesgardencandles.com/rewards and signing up for an account via the step-by-step process outlined on the webpage therein. No purchase is required to enroll in NGR. Only one account is allowed per individual.
You are responsible for keeping secure and maintaining the confidentiality of your password and are fully responsible for all uses of your password and NGR account, whether by you or others. You agree to:
a)log out of your Account at the end of each session;
b)keep your password confidential and not share it with anyone else; and
c)immediately notify Nature’s Garden at info@naturesgardencandles.com of any unauthorized use of your password or account.
You further authorize Nature’s Garden to act on instructions received through use of your password or account. We are not liable for any loss or damage arising from your failure to comply with these Terms.
4.Points: Redemption, Rewards and Expiration
Members of NGR will earn points for a variety of activities related to Nature’s Garden. Primarily, members will earn 1 point for every $1.00 spent on purchases through Nature’s Garden. In addition, members will be awarded points for completing tasks as indicated on the NGR website.:
Points are awarded after reward certificates, discounts, offers or merchandise credits are applied. Items that are ineligible for earning points include gift card purchases, taxes, shipping and all other fees. Point values offered and activities eligible for earning points are subject to change at any time and in Nature’s Garden’s sole discretion. If a user returns merchandise that was previously eligible for points, those points will be removed from the account at time of return.
Once a member accumulates enough points through NGR, they may redeem the points for discounts and exclusive gift options. Member may redeem points by adding merchandise to their online cart via the Nature’s Garden website and applying a coupon code assigned to them with their redemption credit. Coupon expiry will be included in delivery method of e-mail.
The redemption levels, along with information on any discounts or gifts on offer, are available on the NGR website. Once redeemed, NGR points cannot be returned to a member account or exchanged for another reward, except at Nature’s Garden’s sole discretion. Additionally, any NGR points awarded after a product purchase will be removed if the product is returned.
All points earned by NGR members are valid for three hundred and sixty-five (365) days from the date they were earned and will expire at the end of this period unless Nature’s Garden expressly states otherwise. Points are not transferrable between members. Points have no cash value and cannot be exchanged for cash.
5.Use of Account
As mentioned above, NGR members are responsible for maintaining the confidentiality of their password and account and are fully responsible for any and all activities that occur under their password or account. Members should immediately inform Nature’s Garden customer care of any unauthorized use of their password or account or any other breach of security.
NGR is for members’ personal use only. Members agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes any portion of NGR. The transfer, sale, or barter (or the attempted transfer, sale, or barter) of promotional vouchers, member exclusive promotional offers, and any misrepresentation of fact relating thereto, may result in cancellation of the member’s account, including any unused points or claimed but unused promotional vouchers in Nature’s Garden’s sole discretion.
6.Privacy and Consent to Marketing
The information you provide as a member of NGR will be managed by Nature’s Garden as described in thePrivacy Policy. By becoming a member of NGR, you consent to receive marketing, promotions, special events and other communications from Nature’s Garden, its affiliates, and brands. You may unsubscribe from marketing communications at any time. For information on how to do so, please visit our Privacy Policy.
Enrollment in NGR is voluntary. By providing your personal information to Nature’s Garden, you acknowledge that you fully understand and unambiguously consent to the transfer of such personal information to Nature’s Garden, that you are enrolling in NGR voluntarily, and that the enrollment is neither required to complete a purchase transaction nor made in connection with any purchase transaction.
7.Termination, Expiration and/or Changes to Nature’s Garden Points Membership
You may cancel your NGR membership at any time by logging into your account onnaturesgardencandles.com/rewards. Nature’s Garden may cancel your membership at any time for any reason in its sole discretion, including, but not limited to, if it is determined that you:
a)are ineligible,
b)have not used your account for an extended period of time,
c)violated any term or condition of NGR or any applicable law or regulation,
d)used your account in connection with bulk buying or reselling, or
e)engaged in any deception, forgery, fraud or committed any other abuse of NGR.
Nature’s Garden may revoke some or all of your points or rewards if it is determined that you received points or a reward due to an error, through fraud or deception, or in any manner not authorized.
If you or Nature’s Garden cancels your Program membership, you will lose your accumulated points. If you cancel your membership, you may rejoin NGR by registering atnaturesgardencandles.com/rewards. When restarting your membership, your previously earned points will not be reinstated.
In all matters relating to the administration of NGR, the decisions of Nature’s Garden will be final. Nature’s Garden reserves the right to change or cancel any aspect of NGR at any time. If Nature’s Garden changes these Terms, it will give you notice by posting the new Terms here. Those changes will go into effect on the Revision Date shown in the revised Terms. Your continued participation in NGR signifies your agreement to the revised Terms. All interpretations of NGR Terms shall be at Nature’s Garden’s sole discretion. Nature’s Garden’s failure to exercise or enforce any right or provision of these rules shall not constitute a waiver of such right or provision.
8.Other Legal Conditions
NGR IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NATURE’S GARDEN DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO NGR (INCLUDING THOSE RELATED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT AND THOSE ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE).
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NATURE’S GARDEN WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING FOR THE LOSS OF PROFIT, REVENUE, OR DATA) ARISING OUT OF OR IN CONNECTION WITH NGR, HOWEVER CAUSED, AND UNDER WHATEVER CAUSE OF ACTION OR THEORY OF LIABILITY BROUGHT (INCLUDING UNDER ANY CONTRACT, NEGLIGENCE, OR OTHER TORT THEORY OF LIABILITY) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THESE TERMS AND NGR ARE GOVERNED BY THE LAWS OF THE STATE OF OHIO. ANY DISPUTE ARISING FROM THESE TERMS OR IN CONNECTION WITH NGR SHALL BE RESOLVED BY BINDING ARBITRATION IN THE STATE OF OHIO. BY AGREEING TO BINDING ARBITRATION, EACH PARTY UNDERSTANDS THAT THEY EACH FOREVER GIVE UP AND WAIVE ANY RIGHT WHICH EACH PARTY MAY HAVE TO RESOLVE ANY SUCH DISPUTE BY COURT OR JURY TRIAL.
ALL TRADEMARKS, SERVICE MARKS AND TRADE NAMES OF NATURE’S GARDEN USED IN CONNECTION WITH NGR (INCLUDING BUT NOT LIMITED TO THE NATURE’S GARDEN NAME) ARE TRADEMARKS OR REGISTERED TRADEMARKS OF NATURE’S GARDEN. THEY MAY NOT BE USED WITHOUT NATURE’S GARDEN’S PRIOR WRITTEN PERMISSION. ANY OTHER INTELLECTUAL PROPERTY USED IN CONNECTION WITH NGR, INCLUDING BUT NOT LIMITED TO PATENTS, ISSUED OR PENDING, ARE THE SOLE PROPERTY OF NATURE’S GARDEN AND/OR ITS LICENSORS.
